1. Who we are
FotoApta is operated by 杨焕州, an individual developer, trading as “FotoApta” — this is the name shown on the card statement and on the receipt. Contact: contato@fotoapta.com.
2. The service
Free: passport, visa, ID and 3x4 photos are made in your browser, for free and with no watermark.
Paid (one-time): the product “AI professional headshot — 6 high-resolution photos, no watermark” delivers six versions from one selfie (suit, blazer and business shirt, on grey, white and beige backdrops). One payment of US$ 9,99, no subscription, no recurring charge. You see a free preview (marked “PREVIEW”) before paying; once payment is confirmed, the six high-resolution photos are delivered without a watermark.
It is a digital product delivered immediately after payment confirmation, so refunds follow section 4.
3. Payment
Payment is processed by Waffo Pancake and the sale is made by Waffo.com Limited as merchant of record (MoR), which also handles order support and refunds. We never receive, see or store your card data: processing follows the processor’s PCI-DSS standard. Applicable taxes may be charged at checkout.
4. Refunds
Full refund in these cases: (a) the photos were not generated or not delivered because of a failure on our side; (b) duplicate charge caused by a billing error; (c) purchase not yet used, within 7 days; (d) any applicable legal right, such as the 14-day withdrawal period in some countries, when claimed before use.
Once the six high-resolution photos have been delivered, there is no refund, because the digital product has been delivered. To request one, write to contato@fotoapta.com with the email used at checkout and the transaction ID. We reply within 2 business days and the refund is issued within 5–10 business days to the original payment method.
5. Billing disputes
If you think a charge is wrong, contact contato@fotoapta.com before opening a dispute with your bank. We reply within 2 business days and resolve confirmed billing errors within 5 business days.
6. Acceptable use
You may not use the service to: create or spread deepfakes or content passed off as another person; sexual, illegal, defamatory or child-related content; infringe image, privacy or intellectual property rights of others; train, fine-tune or benchmark competing AI models on the service’s inputs or outputs; resell access; or bypass the service security.
7. AI, limits and important notice
Document photos are processed in your browser (MediaPipe, Apache 2.0 licence) and the photo is never uploaded. Paid professional photos use third-party AI models; we keep your selfie only for as long as it takes to generate the photos and delete it right after. We do not use your photos to train models.
AI professional photos are not valid for passports, visas or any official document: official documents do not accept edited or AI-generated photos. Use the free FotoApta tools for that. We apply no beauty filter and do not change your features; results may have flaws and we do not guarantee acceptance by whoever receives the photo.
8. Ownership
The generated photos are yours, for any lawful use. By uploading a selfie you grant us a limited, non-exclusive licence to process it only to generate your photos.
9. Privacy
Use of the service follows our privacy policy.
10. Disclaimer and liability
The service is provided “as is”. We are not liable for indirect or consequential damages; our total liability is limited to the amount you paid in the 12 months before the claim.
11. Governing law
These terms follow the law of the People’s Republic of China. Before any formal proceeding, write to contato@fotoapta.com so we can try to resolve it directly.
12. Changes
We may update these terms; material changes are announced at least 14 days in advance. Continuing to use the service means accepting the current version.
