This policy supplements the Terms of use and applies to everything submitted to FotoApta — in particular the selfie and the text instructions used by the paid “AI professional headshot” feature.
1. Prohibited content
You may not use the service to generate, submit or distribute, directly or indirectly:
- Violence and gore: firearms or blades pointed at people, physical assault, injuries, open wounds, blood, mutilation, dead bodies or scenes of death, torture, extreme suffering, and any graphic depiction of violence against people or animals.
- Hate speech: content that attacks, threatens, degrades or incites violence or discrimination against people or groups based on race, colour, ethnicity, religion, nationality, origin, immigration status, gender, gender identity, sexual orientation, disability or medical condition; including symbols, slogans, uniforms or gestures associated with hate groups.
- Impersonation: deepfakes, face swaps, use of a third party’s likeness without permission, or content presented as being another person.
- Sexual content: nudity, sexualised content and — handled with the highest priority — any sexual content involving minors.
- Illegality and third-party rights: illegal, defamatory or terrorist content, or content that infringes someone’s image, privacy, trademark or intellectual property rights.
2. How we moderate
We apply four layers: (a) automatic validation of the uploaded image before any model call; (b) the providers of the models listed in section 5 run their own safety filters and reject prohibited prompts; (c) manual review of generated images by sampling; (d) mandatory review of every report we receive.
3. Consequences of a violation
- Immediate refusal of the generation: nothing is delivered and the order is not consumed.
- Order block: access to the paid feature is suspended (photos already delivered remain available to download).
- Credits reset: any remaining generations from that order are cancelled, without refund.
- Ban: on repeat or severe violations, the email address and IP address are blocked from making new purchases.
- Retention: the incident is kept for 12 months for our defence and for cooperation with authorities where required.
4. Reporting channel and timelines
Email contato@fotoapta.com with: (a) the generated content or a description of what was generated; (b) the email used at checkout or the transaction ID, if any; (c) the date it happened. We acknowledge receipt within 1 business day, complete the review within 2 business days, and tell the reporter our decision. Reports involving minors are handled with the highest priority and escalated to the competent authorities.
5. AI models used
The paid “AI professional headshot” feature uses the following third-party models:
- Paid photos — primary model: Seedream — ByteDance image generation model, called through the Volcengine Ark API.
- Paid photos — fallback model: Wanx — Alibaba Cloud image generation model (通义万相), used automatically if the primary model fails. Called through the Alibaba Cloud Model Studio / DashScope API.
- Free preview: Qwen-Image-Edit — Alibaba Cloud (Qwen) image editing model, called through the ModelScope API. If a preview is not ready in time, we may use Seedream or Wanx; previews are watermarked and usage limits apply.
No model runs on our own infrastructure: all of them are called through an API. We do not train or fine-tune these models on user photos, and each provider applies its own safety filters before generating.
6. Changes
